TERMS AND CONDITIONS — APEXSPEAK AI

Last update: 19.05.2026These Terms of Use ("Terms") govern your use of ApexSpeak, an iOS application
("the App") provided by Jeremy Williams ("we", "us", "our"). By downloading,
accessing, or using the App, you agree to be bound by these Terms.If you do not agree, do not use the App.1. ABOUT APEXSPEAKApexSpeak is an AI-powered executive coaching application that provides
practice scenarios, feedback, and skill development for soft skills, executive
communication, and influence. The App uses third-party AI services
(including but not limited to Google Gemini, AssemblyAI, and Google Cloud
Text-to-Speech) to analyse your voice recordings and provide feedback.ApexSpeak is a self-improvement and skills-training product. It is NOT a
substitute for professional coaching, therapy, medical advice, legal advice,
or any other regulated professional service.2. ELIGIBILITYYou must be at least 17 years old to use the App. By using ApexSpeak you
confirm that you meet this age requirement and that you have the legal
capacity to enter into this agreement in your country of residence.3. ACCOUNT REGISTRATIONTo use ApexSpeak you must create an account using a valid email address and
password. You are responsible for keeping your credentials confidential and
for all activity under your account. Notify us immediately if you suspect
unauthorised use.4. SUBSCRIPTION, FREE TRIAL & BILLING4.1 Free Trial
New users are offered a 7-day free trial of ApexSpeak Premium
("Premium Monthly", €9.99/month). Trial availability is at Apple's discretion
and may not apply to users who have previously subscribed.4.2 Auto-Renewal
Unless you cancel at least 24 hours before the end of your free trial or
current billing period, your subscription will automatically renew at
€9.99/month and your Apple Account will be charged.4.3 Managing Your Subscription
You can manage or cancel your subscription at any time through your iPhone's
Settings > Apple Account > Subscriptions. Cancelling stops future renewals;
it does not refund the current period.4.4 Refunds
Refunds are handled by Apple under Apple's refund policy. We do not have the
ability to issue refunds directly. To request a refund, contact Apple Support
at reportaproblem.apple.com.4.5 Pricing Changes
We may change subscription pricing at any time. Price changes apply only to
future billing periods. You will be notified before any price increase takes
effect and may cancel before it does.5. EU CONSUMER WITHDRAWAL RIGHTSIf you are a consumer resident in the European Union or the United Kingdom,
you have a statutory right to withdraw from a digital-content subscription
within 14 days of purchase, unless you have already begun using the service
during that period. By starting your free trial and using the App, you
expressly consent to immediate performance and waive your 14-day withdrawal
right with respect to content you have already consumed. You may still cancel
future renewals at any time as set out in section 4.3.6. ACCEPTABLE USEYou agree NOT to:
- Use the App for any unlawful purpose
- Attempt to reverse-engineer, decompile, or extract the source code
- Use the App to harass, defame, or harm others
- Submit content (including voice recordings) that contains illegal material,
hate speech, threats, or content infringing on third-party rights
- Use the App in any way that interferes with other users or our infrastructure
- Resell, sublicense, or commercially redistribute access to the App
- Use automated systems or bots to interact with the App7. YOUR CONTENTWhen you record voice sessions, those recordings and the transcripts derived
from them ("Your Content") are processed by third-party AI services to provide
feedback. We do not claim ownership of Your Content. You grant us a limited
licence to process, transmit, and store Your Content solely to provide the
service to you.You retain all rights to Your Content. You can request deletion of your
account and associated data at any time through the in-app "Delete Account"
feature.8. AI-GENERATED FEEDBACK — IMPORTANT DISCLAIMERThe coaching feedback, scores, and recommendations provided by ApexSpeak are
generated by artificial intelligence systems and are intended for educational
and self-improvement purposes only.AI feedback:
- May contain errors, inaccuracies, or biases
- Should not be relied upon as authoritative career, professional,
psychological, or medical advice
- Does not replace human coaching, mentorship, or professional judgement
- Reflects patterns in training data and is not a measurement of your true
capability or worthYou use AI-generated feedback at your own discretion.9. INTELLECTUAL PROPERTYAll content provided by ApexSpeak (excluding Your Content), including but
not limited to the App's design, branding, scenarios, exercises, copy,
artwork, and underlying coaching frameworks (including the GENOS Emotional
Intelligence framework as adapted within ApexSpeak), is owned by us or our
licensors and protected by copyright and trademark law.You receive a limited, personal, non-transferable, revocable licence to use
the App for personal, non-commercial purposes only.10. THIRD-PARTY SERVICESApexSpeak integrates with third-party services including Apple StoreKit,
Google Gemini, AssemblyAI, and Google Cloud Text-to-Speech. Your use of
these services through the App is also subject to those providers' own
terms and privacy policies.11. PRIVACYYour use of the App is also governed by our Privacy Policy, available at
https://apexspeakaiprivacypolicy.carrd.co/12. DISCLAIMERSThe App is provided "AS IS" and "AS AVAILABLE" without warranties of any
kind, whether express, implied, or statutory, including but not limited to
warranties of merchantability, fitness for a particular purpose, accuracy,
or non-infringement.We do not guarantee that the App will be uninterrupted, error-free, or that
defects will be corrected. We do not warrant any specific outcomes from
using the App (for example, professional success, communication improvements,
or career advancement).Nothing in these Terms excludes any liability that cannot be excluded under
applicable consumer-protection law.13. LIMITATION OF LIABILITYTo the maximum extent permitted by law, our total liability to you for any
claim arising from your use of the App shall not exceed the amount you have
paid us in the 12 months preceding the claim.We shall not be liable for any indirect, incidental, special, consequential,
or punitive damages, including lost profits, lost data, or business
interruption, even if we have been advised of the possibility of such damages.This limitation does not apply to liability for death, personal injury caused
by negligence, fraud, or any other liability that cannot be limited under
applicable law.14. APPLE-SPECIFIC TERMSThe following terms apply where you have downloaded the App from the Apple
App Store:14.1 These Terms are between you and us only, NOT with Apple. Apple is not
responsible for the App or its content.14.2 The licence granted to you is limited to use of the App on Apple-branded
devices that you own or control, and as permitted by the Apple Media Services
Terms and Conditions.14.3 Apple has no obligation to provide maintenance or support for the App.14.4 If the App fails to conform to any applicable warranty, you may notify
Apple, who will refund the App's purchase price (if any). Apple has no other
warranty obligation.14.5 We, not Apple, are responsible for addressing any claims by you or any
third party relating to the App, including product-liability claims,
consumer-protection claims, and claims that the App fails to conform to
legal or regulatory requirements.14.6 We, not Apple, are responsible for the investigation, defence,
settlement, and discharge of any third-party intellectual-property
infringement claim relating to the App.14.7 You represent that you are not located in a country subject to a US
Government embargo or designated as a "terrorist supporting" country, and
that you are not on any US Government list of prohibited or restricted
parties.14.8 Apple and Apple's subsidiaries are third-party beneficiaries of these
Terms and, upon your acceptance, will have the right to enforce these Terms
against you as a third-party beneficiary.15. ACCOUNT TERMINATIONYou may terminate your account at any time via the in-app "Delete Account"
feature. We may suspend or terminate your account if you breach these Terms,
with reasonable notice where practicable. Upon termination, your right to
use the App ceases, but sections that by their nature should survive
(intellectual property, disclaimers, limitations of liability, governing law)
shall remain in effect.16. CHANGES TO THESE TERMSWe may update these Terms from time to time. We will notify you of material
changes within the App or by email. Continued use of the App after notice
constitutes acceptance of the updated Terms.17. GOVERNING LAW & JURISDICTIONThese Terms are governed by the laws of France. Disputes shall be subject
to the exclusive jurisdiction of the competent courts of France, subject
to any consumer-protection rights you have to bring proceedings in your
